This Privacy Policy explains how Wiens & Roth Commercial ("we," "our," "us") collects, uses, discloses, and safeguards information when you visit www.wiensandrothcommercial.com (the "Platform") or interact with our broker services.

1. Information we collect

Account credentials: password (stored hashed, never in plain text).
Signed agreements: typed e-signature, signing IP address, timestamp, and agreement version on confidentiality agreements (CAs).
Activity data: data room access logs, documents opened, time spent.

We collect information automatically through your browser, including IP address, user agent, referring URL, and pages viewed.

2. How we use information

To verify your identity and grant access to confidential offering materials.
To produce a legally binding signed confidentiality agreement (CA) PDF as proof of signing.
To notify the assigned listing agent about your interest in a specific property.
To sync lead information to our customer relationship management system (FollowUpBoss) for ongoing broker follow-up.
To improve the Platform, debug, and analyze usage patterns.
To comply with legal obligations.

3. Sharing information

We do not sell your personal information. We share information with:

Wiens & Roth Commercial agents assigned to listings you express interest in, so they can follow up.
Service providers who help us run the Platform: Vercel (hosting), Supabase (database), Resend (transactional email), FollowUpBoss (CRM), Dropbox (document storage). These vendors are contractually obligated to protect your information.
Property sellers, on a need-to-know basis, when your inquiry advances to active negotiation.
Legal authorities if required by law, court order, or to protect rights, safety, or property.

4. Confidentiality agreements

When you electronically sign a confidentiality agreement (CA) for a listing, we permanently retain a copy of the signed CA, including the typed signature, your IP address at the time of signing, and the timestamp. This record may be relied upon by Wiens & Roth, the seller, and their attorneys to enforce the CA against you in the event of a breach.

5. Data retention

Account and CA records are retained indefinitely for legal and compliance purposes. Browsing activity logs are retained for up to 24 months. You may request deletion of your account by emailing deals@wiensandrothcommercial.com, though we will retain signed CAs as required for legal enforcement.

6. Your rights

Depending on your state of residence (California, Colorado, Connecticut, Virginia, Utah, and others), you may have the right to: access the personal information we hold about you; request correction or deletion; opt out of certain processing; and receive a portable copy of your data. To exercise these rights, email deals@wiensandrothcommercial.com. We will respond within 45 days.

7. Cookies

We use minimal cookies for session management (authentication) and limited analytics. We do not use cross-site advertising trackers. Your browser settings let you reject cookies, though doing so may break login functionality.

8. Children

The Platform is intended for commercial real estate professionals and investors. We do not knowingly collect information from anyone under 18.
